Governor John Bel Edwards issued Executive Order 168 JBE 2020 which imposes more restrictions than set forth in his previous Phase 3 Orders. The current edict is being referred to as "modified Phase 2." Essentially, limitations on capacities have been made more restrictive. I have read the Order and submit the following outline for quick reference . However, I strongly encourage any business or organization to register and/or consult https://opensafely.la.gov/ for case specific guidance. THE ORDER IS IN EFFECT PRESENTLY AND CONTINUES UNTIL DECEMBER 23, 2020.


EXECUTIVE ORDER 1 68 JBE 2020 NOVEMBER 24, 2020

Businesses which must remain closed:

All places of amusement must remain closed including but not limited to those with amusement rides, carnivals, splash pads, water parks, arcades, fairs, festivals, indoor playgrounds , theme parks, and concert/music halls. However, Section B (5) of the Order provides that any such business may submit a reopening plan with proposals for occupancy and sanitization to the Office of State Fire Marshal which is authorized to permit the opening of the business. Nonetheless, the occupancy thereof cannot exceed 25%.

BARS AND LOUNGES

No bar, with or without a food service permit from the La. Department of Health shall allow for INDOOR, ON PREMISES sale or consumption of food or drinks. A bar may provide for takeout, drive thru, or curbside delivery of food or drinks.

A bar may be open for OUTDOOR service and consumption except that the outdoor capacity cannot exceed 50 patrons . Also, these conditions apply for outdoor services:

If the capacity is less than 50 persons, then the capacity limit is the maximum number of patrons allowed.

The bar cannot open before 8:00 A.M. and must close by 11:00 P.M.

There can be no walk-up service; hence all patrons must be seated at tables.

Tables must be "socially distanced," meaning spaced 6 feet apart.

No one can enter the area unless they are of the age to purchase alcohol.

Notwithstanding the foregoing, a bar may be allowed to be open for INDOOR service if it is in a Parish which has a percent positivity of 5% for two consecutive weeks under the data published by the La. Department of Health. IBERIA PARISH DOES NOT CURRENTLY MEET THAT CRITERIA; THUS, CURRENTLY BARS IN THE PARISH MUST BE CLOSED FOR INDOOR SERVICES.

If,and once, a bar is allowed to open for indoor services (the Parish meets the 5% threshold) , then the re-opening must be under these conditions:

The capacity cannot exceed 25% occupancy as set by the Office of State Fire Marshal, or 50 patrons, whichever is less.

The bar cannot open before 8:00 AM. and must close by 11:00 P.M.

There can be no walk-up service; hence all patrons must be seated at tables. Tables must be "socially distanced," meaning spaced 6 feet apart.

No one can enter the bar unless they are of the age to purchase alcohol.

ESSENTIAL BUSINESSES

There is no change.

RESTAURANTS, CAFES, AND COFFEE SHOPS

There has been no change except that the establishment cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

BEAUTY SHOPS, SALONS, AND BARBER SHOPS

There has been no change except that the establishment cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

SHOPPING MALLS

There has been no change except that the establishment cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

CHURCHES AND OTHER FAITH-BASED ORGANIZATIONS

There has been no change.

CASINOS, RACETRACKS, AND VIDEO POKER ESTABLISHMENTS

There has been no change except that the establishment cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

GYMS AND FITNESS CENTERS

There has been no change except that the establishment cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

ATHLETIC EVENTS

There has been no change.

EVENT CENTERS AND RECEPTION HALLS

No establishment can exceed 25% of the total occupancy or 75 people, whichever is less, as determined by the Office of State Fire Marshal. Otherwise, there has been no change.

ALL OTHER BUSINESS OR ORGANIZATIONS

There has been no change except that the establishment or organization cannot exceed 50% of the total occupancy, as opposed to 75% under the previous order.

LIMITATIONS ON CROWD SIZES-INDOOR

Under the proclamation issued November 24, 2020, 168 JBE 2020, crowd sizes shall be limited to no more than 25% capacity as set by the Fire Marshal WITH A MAXIMUM OF 75 people in any single space at the same time.

LIMITATIONS ON CROWD SIZES-OUTDOOR

Under the proclamation issued November 24, 2020, 168 JBE 2020, crowd sizes shall be limited to no more than 25% capacity as set by the Fire Marshal WITH A MAXIMUM OF 150 people in any single outdoor space where individuals are in close proximity to one another and unable to maintain social distancing of 6 feet from those who are not immediate family members.

MASK MANDATE

The mask mandate continues without any change whatsoever.
